Aarushi murder case: Talwars' charged with murder, trial to begin from June 4
Ghaziabad, The special CBI court in Ghaziabad on Friday formally framed charges against Rajesh and Nupur Talwar for the murder of their 13-year-old daughter Aarushi and their domestic help Hemraj in May 2008 at their home.
The trial will now begin from June 4.
On Thursday, in his six-page order, additional district judge Shyam Lal said there was enough evidence, prima facie, to try the dentist couple under sections 302, read with 34 (murder with common intention) of Indian Penal Code, and section 201, read with 34 (destruction of evidence with common intention). CBI counsel R K Saini told the media that after formal framing of charges on Friday, the court will gave the next date for commencing the trial.
Briefing the media on the closed door hearing, CBI counsel R K Saini said, "The court has agreed with the argument that since there were four persons in the house in May 15 night and two were found dead, the onus was on surviving members to explain what transpired on the fateful night."
Citing a number of Supreme Court and High Court judgments, the judge said evidence cannot be minutely examined at the stage of framing of charges and there was enough prima facie ... Read Full Story

Arushi murder case: Nupur Talwar denied bail, moves Supreme Court
Ghaziabad, Holding that legal history is replete with instances of filicide, a special CBI court today denied bail to dentist Nupur Talwar in the sensational 2008 double murder of her daughter Aarushi and domestic help Hemraj.
As she prepared for her third day of stay in the Dasna jail, Nupur's lawyers immediately moved for bail in the Supreme Court where she has already sought a review of its decision giving a go ahead to the criminal prosecution of her and her dentist husband Rajesh Talwar.
Disposing of her petition, additional district and sessions judge S Lal said he cannot exercise the discretion of giving the bail to Nupur since "there is a prima facie evidence to suggest the involvement of the accused (Nupur)" in the light of the seriousness of the offence and severity of the punishment provided.
"The legal history is replete with instances of matricide, patricide and fratricide. Everything is possible in these days of modern era wherein moral values are fast declining and one can stoop to the lowest extent ... She is accused of killing her own progeny, who was in her teens, apart from killing domestic help Hemraj, who had come over from Nepal to eke out a ... Read Full Story

Aarushi murder case: Ghaziabad court rejects Nupur Talwar's bail plea
New Delhi, The special CBI court on Monday rejected the bail plea of Nupur Talwar, mother of the murdered 14-year-old Aarushi. She would be taken to Dasna jail in Ghaziabad.
Her lawyers had applied for bail on the grounds that she is a woman, and is therefore entitled to leniency. They also pointed out that her husband Rajesh Talwar, also accused in the case, has already been granted bail and so Nupur should be treated at par. But the CBI opposed Talwar's bail, describing the crime that she is accused of as "heinous."
Earlier on Monday morning, she surrendered in the Ghaziabad court following a Supreme Court directive last week.
The court took Nupur Talwar in the custody, which means that this is for the first time she will be lodged in jail. After being taken into the custody, Nupur Talwar filed a bail application immediately.
Filing its reply on Nupur's bail plea, CBI opposed her bail as she had evaded the arrest for a long time.
CBI sources told Times of India that they have sufficient evidence on record against her. Rajesh Talwar was also present in the court.
On April 27, Nupur Talwar was directed by the Supreme Court to surrender on Monday before the trial ... Read Full Story

Aarushi's parents to face trial, Supreme Court rules
New Delhi, The Supreme Court Friday allowed the trial of dentist couple Rajesh and Nupur Talwar for the murder of their teenaged daughter Aarushi.
The Talwars had approached the Supreme Court to overrule the verdict of a lower court that ordered the Central Bureau of Investigation (CBI) to make them the main accused in the case.
A bench of Justice A.K. Ganguly and Justice J.S. Khehar said there was nothing wrong in the magistrate's order taking cognizance against the Talwars and putting them on trial.
"We dismiss the appeal," the bench said.
Fourteen-year-old Aarushi, a student of Delhi Public School, was found with her throat slit in her parents' Noida apartment May 16, 2008.
The family's domestic help, Hemraj, whom the police initially thought to be the prime suspect, was also found killed on the apartment's terrace a day later.
The couple's counsel Rebecca John said: "There is nothing beyond this. They have to face the trial."
